Protective Covenants

*COVENANTS IN PLACE TO PROTECT YOUR INVESTMENT*

1. No building erected or to be erected on the lot shall be used for any purpose other than that of a single, private dwelling house for a single family, together with the necessary garage that may be desired in connection with such dwelling unless the written consent of the Grantor herein is first obtained.

2. No more than one dwelling house shall be erected or stand at any one time on any one of the said lots.

3. Construction of a dwelling house on said lot shall begin within twelve (12) months from the date of purchase, and construction shall be completed according to the plans and specifications within twelve (12) months from the date of commencement of construction or as approved in writing by Perry Lake Developments Inc., its successors or assigns, or its or their agent.

4. No building or other structure shall be commenced constructed or maintained on the lot herein conveyed nor shall any addition to or alteration thereof be made until the plans and specifications showing the nature, location, materials, and height of each such structure shall have been submitted to and approved in writing by Perry Lake Developments Inc., its successors or assigns, or its or their agent.

5. No trailers or mobile homes shall be placed or permitted to remain on any lot except that a vacation trailer may be stored on the premises temporarily.

6. No major repairs or construction of any motor vehicle or vessel shall be effected save within a wholly enclosed garage, nor shall any derelict or abandoned vehicles remain upon Lands.

7. Any building including steps, verandah or porch shall be erected at such distance from a street or side line as to meet all municipal requirements in respect thereto.

8. Other than such trees as must be removed in connection with the excavation and building for such dwelling, no trees on any lot shall be cut without the consent in writing of the Grantor, Perry Lake Developments Inc., or its agent.

9. The disturbed area between the front of any dwelling house and the street other than walks and/or driveways shall be seeded or sodded and walks and driveways shall be surfaced either by asphalt, concrete or gravel.

10. All lots shall be kept clean and sanitary at all times and no waste material of any kind shall be dumped or spread on the lot except clean earth, rocks, gravel or ashes for the purpose of leveling of said lot.

11. No house garbage shall be placed outside of any dwelling unless kept in a garbage enclosure specially constructed for that purpose.

12. No signs, billboards, notices of advertising matter of any kind shall be placed on any part of the said lot or buildings other than the usual signs offering the property for sale or rent.

13. No animals, other than domestic pets that are intended to reside for the most part in a residential dwelling with the family, shall be brought to reside on the lands. there shall be no breeding of any animals in the subdivision.

14. No fence shall be erected on the said lot or any part thereof, unless approved by the Grantor, Perry Lake Developments Inc.

15. No house may be built or erected on said lot having less than 1800 total square feet above grade, and no less than 1000 square feet of main floor space, excluding garage, unless permission is first obtained in writing from Perry Lake Developments Inc. The exterior walls and finishes of any building located on any Lands shall be of earth tone color and the building side facing the street shall have no less than 250 sq feet of brick or stone, unless otherwise approved by the Grantor, Perry Lake Developments Inc. in writing. No building or erection may be more than 2 stories in height unless permission is first obtained in writing from Perry Lake Developments Inc.

16. There is a legal requirement under the Nova Scotia Water Act to obtain a permit prior to commencing any work in or around the immediate vicinity of any watercourses, including lakes, rivers and streams. A few examples of the type of work which would require a permit would be wharf construction, shoreline excavation or modifications, boat ramp construction, watercourse diversions, dam constructions, culvert installations, etc..

17. Perry Lake is by its size and location, environmentally sensitive. The Purchaser agrees that no motorized vessels or vehicles will be permitted on Perry Lake.

18. No person shall sub-divide any existing lot without the written consent of Perry lake Developments Inc.

19. It is understood and agreed that if the Purchaser does not complete with agreement in accordance with the terms thereof the Purchaser will forfeit the deposit in addition to any other claims which the Vendor may have against the Purchaser for the Purchaser's failure to so complete.

20. Time shall in all respects be of the essence in this Agreement.

21. This Agreement shall endure to the benefit of and be binding upon the parties hereto, their respective heirs, executors, administrators, successors and assigns.

22. This agreement is to be read with all changes of gender or number required of the context.
